Abstract

The article analyzes the correlation between the institution of proof and the claim (pre-trial) procedure for dispute resolution as interrelated legal mechanisms for protecting violated rights and legitimate interests of participants in civil circulation. The legal nature of proof and pre-trial claims is examined, and their functional features and significance at various stages of dispute resolution are revealed. Particular attention is paid to the role of evidence in the formation and substantiation of claim demands, as well as to the impact of compliance or non-compliance with the claim procedure on the process of proof in court.
